GuardenLabs is a product and technology platform operated by BloomGuarden, LLC, and is distinct from BloomGuarden's consulting services.

  • Usage Data: IP address, device type, browser, timestamps, feature usage, and interaction logs

  • Cookies & Tracking Technologies: Used to support authentication, analytics, security, and performance

1.3 Sensitive Information

GuardenLabs does not require or intentionally collect sensitive personal data (e.g., health data, religious beliefs, SSNs).
You are responsible for ensuring that any data you upload complies with applicable privacy and employment laws.

2. How We Use Information

  • Operate, maintain, and improve the GuardenLabs Platform

GuardenLabs does not use customer data to train public or third-party AI models.

  • Outputs do not constitute legal, tax, accounting, or employment advice

  • Users remain responsible for how outputs are interpreted or implemented

We strongly recommend professional review before acting on any output.

Terms of Service for GuardenLabs

These Terms of Service ("Terms") govern your access to and use of the GuardenLabs Platform. By creating an account or using the Platform, you agree to these Terms.

1. Eligibility & Accounts

  • You must be at least 18 years old

  • You are responsible for maintaining account security

  • You must provide accurate and lawful information

2. Platform Use

GuardenLabs provides AI-enabled tools for workforce analysis, organizational modeling, and HR-related simulations.

You agree not to:

  • Upload unlawful, misleading, or unauthorized data

  • Reverse engineer or misuse the Platform

  • Use outputs for discriminatory or unlawful purposes

  • Circumvent safeguards or security controls

3. No Professional Advice

GuardenLabs outputs are:

  • Educational and analytical only

  • Not legal, HR, tax, accounting, or compliance advice

  • Not a substitute for professional judgment

You assume all responsibility for decisions made using the Platform.

4. Intellectual Property

  • The Platform, software, models, workflows, and branding are owned by BloomGuarden, LLC

  • You retain ownership of your uploaded data

  • You grant GuardenLabs a limited license to process data solely to provide the Platform

5. Subscriptions & Payments

  • Fees are billed per selected plan

  • All fees are non-refundable unless required by law

  • We may modify pricing with advance notice

6. Availability & Modifications

We may modify, suspend, or discontinue features at any time. We do not guarantee uninterrupted availability.

7. Limitation of Liability

To the maximum extent permitted by law:

  • GuardenLabs is provided "as is"

  • We are not liable for indirect, incidental, or consequential damages

  • Total liability will not exceed fees paid in the prior 12 months

8. Indemnification

You agree to indemnify and hold harmless GuardenLabs and BloomGuarden, LLC from claims arising from:

  • Your use of the Platform

  • Data you upload

  • Violation of these Terms or applicable laws

9. Governing Law

These Terms are governed by the laws of the State of Illinois, without regard to conflict of law principles.

10. Changes to Terms

We may update these Terms periodically. Continued use constitutes acceptance.
